                             REASONS FOR MAKING A WILL

  • To save uncertainty, trouble, delay and expenses following your death.
  • To avoid arguments in your family after your death.
  • To prevent your spouse's family inheriting everything if you and  your spouse both die together.
  • Unmarried partners do not automatically inherit, thus making a will is necessery if they are to be provided for.
  • If you have children, you need a will to appoint guardians and to make financial provision for their upkeep and education.
  • You may need to delay or prevent the sale of your home if someone in your family needs to continue living in it.

                     WHAT HAPPENS IF YOU DON'T MAKE A WILL

  • The law says who inherits your property and how much you get.
  • Unmarried partners receive nothing.
  • Married partners receive your personal effects and motor cars ( but no business assets ) and the first £125,000 free of tax ( £200,000 if there are no children ). Your married partner receives a life interest in half of the residue which passes to your children on your partners death.
  • The rest of your property will be inherited by your children. If you have no children, then your grandchildren. If no grandchildren, then your parents or brothers or sisters.
  • Your married partner will only inherit everything if there are no such relatives.
  • If you have no married partner, children, grandchildren, parents or brothers and sisters, your estate will be inherited by your grandparents or aunts and uncles or by the State.
